We won!! (and lost). We're at $1,500 and growing!
StopSpam has so far reached a settlement with three defendants: two national telephone companies (the settlements included confidentiality agreements), and the third with SunTerra, a time-share vendor. In two cases, these suits were based on violations of the ADAD (automated dialing and announcing device) section of Washington law. This "phone spam" is also illegal under the law--and their lawyers KNEW IT! In both cases, agreement was reached without needing to go to court. So, we're up over on these "phone spammers." But we also lost two suits in court. The first was dismissed "without prejudice" because the judge was unwilling to hear a case involving an out-of-state defendent. The second case, against Speakeasy.net, was dismissed because the judge did not believe that the ISP originated the spam. So, we're three for five, and ahead by $1,500. More cases to come.
